[Note: Joshua III Fuller 1774 – 1805,  died intestate (without a Will) and below are his Probate Court Records (transcribed) which in the most part corroborate the information on the immediate family recorded in the Massachusetts  vital records and history books as follows:

29 Aug 1805 –  Petition to the Court request to appoint an Administrator

To the Hon.  James Prescott Judge of Probate in & for the county of Middlesex.

May it please your Honor.

My late husband, Joshua Fuller just having died Intestate it is my request that your Honor would please to appoint Timothy Jackson Admin[istrato]r of his estate.

3 Sept 1805 –  Bond/Appointment of Administrator   

KNOW all Men by these Presents    That we

Timothy Jackson, Esq. as principal, & Joshua Fuller, Husbandman & George Stearns, Yeoman as sureties and all of Newton in the County of Middlesex & Commonwealth of Massachusetts  

within the commonwealth of Massachusetts, are holden and stand firmly bound and obliged unto James  Prescott  Esq. Judge of the Probate of wills, and granting administrations within the county of Middlesex in the full Sum of Thirty Thousand dollars in lawful money of said commonwealth, to be paid unto the said James Prescott Esq. his successors in the said office, or assigns;  To the true payment whereof, we do bind ourselves and each of us, our, and each of our heirs, executors, and administrators, jointly and severally, for the whole, firmly by these presents. Sealed with our seals, Dated the Third  day of  September in the year of our Lord one thousand eight hundred and  five.

The CONDITION of this present OBLIGATION  is such, That if the above bounden Timothy Jackson, whom is appointed administrator of the estate of Joshua Fuller ju[nio]r late of Newton in the said County, husbandman, deceased, intestate

do make or cause to be made a true and perfect inventory of all and singular the goods, chattels, rights and credits of the said deceased, which have or shall come to the hands, possession or knowledge of the said Timothy Jackson or into the hands and possession of any other person or persons for him and the same so made, do exhibit, or cause to be exhibited into the  registry of the Court of Probate for the aforesaid county of Middlesex at or before the  third day of  December   next ensuing; and the same goods, chattels, rights and credits, and all other the goods, chattels, rights and credits of the said deceased, at the time of  his  death, which at any time after shall come to the hands and possession of the said   Timothy Jackson    or into the hands and possession of any other person or persons for him  do well and truly administer according to law; and further, do make or cause to be made a just and true account of  his  said administration upon oath, at or before the  third   day of   September   which will be in the year of our Lord, one thousand  eight hundred & six .

And all the rest and residue of the said goods, chattels, rights and credits which shall be found remaining upon the said administrators  account, (the same being first examined and allowed of by the Judge or Judges, for the time being, of Probate of Wills and granting administrations within the County of  Middlesex  aforesaid) and shall deliver and pay unto such person or persons respectively, as the said Judge or Judges by his or their decree or sentence pursuant to law shall limit and appoint:

And if it shall hereafter appear that any last will and testament was made by the said deceased, and the executor or executors therein named do exhibit the same into the court of Probate for the said county of  Middlesex  making request to have it allowed and approved accordingly; if the said     Timothy Jackson     within bounden being thereunto required, do render and deliver the said letter of administration (approbation of such testament being first had and made)  into the said court: Then the before written Obligation to be void and of none effect, or else to abide and remain in full force and virtue.

30 Oct 1805 – Appointing Appraisers to take an Inventory of Estate

COMMONWEALTH OF MASSACHUSETTS.

Middlesex ss. The Honorable  James Prescott, esquire, Judge of the court of probate in and for the county of Middlesex aforesaid,

To     Deacon Joseph Fuller, Messrs. Henry Craft & George Sterns, all of Newton in said County                                                                
Greeting.

You are hereby appointed and empowered, three suitable persons to take an inventory of all the estate whereof Joshua Fuller junior  late of   said Newton  in said county of Middlesex,    husbandman, deceased intestate     died seized and possessed in the Commonwealth aforesaid;  and, according to your best skill and judgement, truly and justly to appraise the same, as soon as may be, in dollars and cents, according to the present value thereof, being first sworn to the faithful discharge of that trust:   And when you shall have completed the said inventory, as aforesaid, you are to deliver the same, together with this warrant, with your doings thereon, sealed up, to the  Administrator of the  Estate  of the said deceased, who is hereby accordingly directed so to return and exhibit the same, on oath, into the probate office of the said county of Middlesex, within three months from the time of taking upon himself that trust.

Witness the said   James Prescott   esquire,  Judge as aforesaid, under his hand and seal official, this  third   day of  September   in the year of our Lord one thousand eight hundred and  five.

COMMONWEALTH OF MASSACHUSETTS.   

Middlesex ss.   At a Court of Probate, holden at   Cambridge   in and for said county, the  fifteenth  day of  November  A.D. 1805

The foregoing having been duly returned, and this day exhibited, on oath, by Timothy Jackson the administrator of the   Estate    of the said deceased, as a true and perfect inventory of all the estate of said deceased, that has hitherto cone to his hands, possession, or knowledge; and the said   administrator     having made oath, that if any further estate of said deceased shall hereafter come to his    possession or knowledge, he will render a just and true account thereof into the Probate office, to be of record herewith;   it is therefore decreed by the Judge of said Court now here, that the same be, and it is hereby accordingly accepted, and ordered to be recorded.         [signed] James Prescott, J. 5 Nov 1805 – Petition to the Court by Hannah Fuller, Widow

To the honorable  James Prescott, Esquire, Judge of the court of Probate for the county of Middlesex, in the Commonwealth of Massachusetts,

Humbly shows  Hannah Fuller of Newton in the county of Middlesex, widow that Timothy Jackson of Newton in the county of Middlesex & Esq., is administrator of the estate of Joshua Fuller late of Newton  in the county of Middlesex, gentleman  deceased, intestate; that she was the lawful married wife of the said Joshua Fuller,  at the time of his death; that the personal estate of said deceased will not be sufficient to pay his just debts and funeral charges, or that there will be little or no surplus left; and that she is nevertheless entitled to her apparel and such other of the personal estate of said deceased, as your Honour shall determine necessary, according to her quality and degree.

Wherefore the said widow prays your Honour to allow her such part of the personal estate of said deceased, as you shall judge fit and reasonable, pursuant to the law in such cases made and provided

Dated at  Cambridge  this fifth day of November, A.D. 1805

COMMONWEALTH OF MASSACHUSETTS.

Middlesex ss.   At a Court of Probate, holden at  Cambridge   in and for said county, the  fifth  day of  November  A.D. 1805

Having made all needful inquiries, touching the forgoing petition, and fully understanding the same, it appears to the Judge of said court, that the said widow is entitled to here reasonable allowances, as therein prayed for.

It is therefore decreed by the said Judge now here, that the said widow have and receive, to her own use, such articles, beside her apparel, out of said deceased’s personal estate, as she may have occasion for, to the amount of  one hundred & fifty dollars [$150], according to the appraisal thereof in the inventory of said estate, which shall not be assets in the hands of said [administrator.]

5  Nov 1805 – Court Appoints Commissioners to Examine Claims on the Estate

COMMONWEALTH OF MASSACHUSETTS.

Middlesex ss. The Honorable  James Prescott, Esquire, Judge of the Court of Probate in and for said county,

To     Stephen Dana Esq. of Cambridge & Henry Craft of Newton, both in the County of Middlesex in the Commonwealth aforesaid.

Greeting.

Forasmuch as the condition and circumstances of the estate of  Joshua Fuller Jr. late of Newton  

in the county of Middlesex aforesaid  husbandman deceased, intestate, have been duly represented to the Judge of sais court by  Timothy Jackson of Newton in the county of Middlesex Esquire Administrator of the Estate of said deceased, and thereupon it hath appeared to the said Judge that the said estate will prove to be insolvent, and a commission of insolvency hath been accordingly awarded thereon, as by the record and proceedings in the same court is manifest:

YOU therefore the above named Stephan Dana & Henry Craft  are hereby nominated and appointed to be commissioners, with full power to receive and examine all claims, except those in favor of said Adm[inistrato]r,  of the creditors of said estate, being first duly sworn to the faithful discharge of the trust hereby reposed in you;  you are to cause the times and places of your meeting, to attend them for that purpose, to be first made known by causing notification thereof to be posted up in some public place in the shire town of the county of Middlesex and of the two next counties, or by causing an advertisement thereof to be printed three weeks successively in the public newspaper printed at  Boston by Benjamin Russell;

And you are hereby authorized and empowered to examine by the oath or affirmation, ass the case may require, of any creditor the truth of any claims by such creditor presented, to be administered by either of you, when sitting by virtue of this commission, and it shall be adjudged expedient by you to require the same; 

And six months are hereby allowed to the said creditors for bringing in and proving their claims;  at the end of which time, you are to make report and present to the Judge of said court, upon oath, as aforesaid, a list of all the claims that shall have been laid before you, describing how they are made out, with the sums you shall allow on each claim, so that distribution of said estate to and among the creditors thereof may be made, as by law in such cases made and provided; 

And you are to note the debts due for all rates and taxes, debts due to the Commonwealth, debts incurred for the last sickness of the deceased and necessary funeral expenses, particularly, in a distinct class:  And you will exhibit a plain and true account of your care and labour in examining the claims, as aforesaid, that you may be entitled to meet recompense therefor out of the deceased’s estate.

Finally, you are to make due return of this commission, with your doings thereon in all things as herein directed.

Middlesex ss.       16 December  A. D.  1805     Then the above named  Stephen Dana & Henry Craft                          personally appeared and made oath,  that they would faithfully and impartially discharge the trust reposed in them by the forgoing commission,

Nov 5,  1805  – Court Accepts Administrator Affidavit

  Timothy Jackson of Newton in the county of Middlesex Esq. Administrator of the Estate of Joshua Fuller Jr.  late of Newton in said county of Middlesex  Husbandman deceased, intestate, do testify and say, that in pursuance of the directions of the Honorable  James Prescott Esq. Judge of Probate, &c. for said county, dated in third day of September  1805.    I did within three months from the third day of September viz. on the Seventeenth day of said September post in said Newton Notifications of my appointment to and acceptance of said trust, and that the within the said three months I did also post notifications of the same tenor and date in public places in the towns of Waltham & Watertown

as adjoining towns required by the directions aforesaid.

And I do further testify, that I did within the said three months cause the same to be inserted three weeks successively in the newspaper printed by Young & Minns at Boston beginning on the Seventeenth day of Sept[embe]r last   And that the following is a true copy of the notification poster and published as aforesaid,  viz.

NOTICE is hereby given, that the subscriber has been duly appointed

 Administrator to the Estate of Joshua Fuller Jr.  late of Newton in the county of Middlesex, Husbandman deceased, intestate, and has taken upon him self that trust by giving bonds, as the law directs. All persons, having demands upon the estate of the said Joshua Fuller are required to exhibit the same; and all persons, indebted to the said estate, are called upon to make payment to

Personally appeared the above named  Timothy Jackson and being duly cautioned to relate the whole truth, made solemn oath that the foregoing affidavit by him subscribed, contained the truth, and nothing but the truth, relative to the transaction therein mentioned; and it being made within the time limited by law, to perpetuate the remembrance of the thing, I order that the same be recorded.

5 Nov 1805 – Petition the Court by Administrator to Sell Inventory

To the Honorable   James Prescott Esquire, Judge of the Court of Probate for the county of Middlesex, in the Commonwealth of Massachusetts,

Humbly shows   Timothy Jackson Adm[inistrato]r  of the Estate of Joshua Fuller Jr. late of Newton in the county of Middlesex, Husbandman  deceased, intestate, that it will be more for the benefit of those concerned in the estate of said deceased, that the whole of the  personal estate of said deceased, whereof no special disposition hath already been duly made, should be sold at  Public or private sale   than to hold the said Adm[inistrato]r to account for the same, according to the appraisal thereof in the inventory of said estate;

Whereof the said  Adm[inistrato]r prays your Honour would order the same to be sold at  public or private sale   pursuant to the law in such cases made and provided

Having made all needful inquiries, touching the forgoing petition, and fully understanding the same, it appears to the Judge of said court, that the prayer thereof ought to be granted.  It is therefore decreed by the said Judge, now here, that the personal estate of said Lunatic be sold at public or private sale as therein prayed for.

5 Nov 1805 – Administrator submits a summary of solvency to the Court

To the honorable  James Prescott, Esquire, Judge of the court of Probate for the county of Middlesex, in the Commonwealth of Massachusetts,

Humbly show  Timothy Jackson  of Newton in said County as he is Administrator of the Estate of Joshua Fuller Jr.  late of Newton in the county of Middlesex  aforesaid Husbandman, deceased intestate, that the condition and circumstances of the estate of sais deceased are as follows, viz.

Wherefore the said Adm[inistrato]r  pray your honour to nominate and appoint two or more fit persons to be commissioners to receive and examine all claims of the several creditors of said estate, pursuant to the law in such case made and provided.

Middlesex ss.    At a Court of Probate holden at  Cambridge in the said county, the fifth day of November A.D. 1805

Forasmuch as the above named Timo[thy] Jackson has this day, on oath, exhibited the foregoing representation, by him subscribed, and having made all needful inquires, touching the same, and all and singular the premises being seen and fully understood, it appears to the Judge of said court, that the estate of said intestate will prove to be insolvent;     It is therefore decreed by the said Judge now here, that two fit persons be appointed commissioners to receive and examine all claims of the several creditors of said estate, and a commission of insolvency is hereby awarded thereon, in manner and form as the law in such case provides; and six months are allowed to the said creditors for bringing in and proving their claims; and Stephen Dana Esq. of said Cambridge & Henry Craft of said Newton, Yeoman, are hereby nominated and appointed such commissioners accordingly.

5 May 1806 – Court Accepts Commissioners report of Creditors

To the honorable James Prescott Esq[uire] Judge of the Probate of Wills &c. for said County of Middlesex.  We the subscribers Commissioners name in the annexed Warrant having listed the times and places of our meeting to attend the Creditors to the Estate therein mentioned for reviewing and examining their Claims to be make known agreeable to same and having been sworn as on said Warrant is Certified, do make our Report and on Oath present to your Honor a list of all Claims which have been laid before us, and the sum we allow on each claim to wit

Middlesex, ss.                    5 May AD 1806, It is decreed by the Judge of Probate &c. for said County, that the foregoing report be received & filed in the Probate pursuant to law, to the end that all parties concerned may inspect the same & file their objections, if any they have, written twenty days to commence on the present day.

9 June 1806 – Court Order a Citation of Estate to be Published 

COMMONWEALTH OF MASSACHUSETTS.       

Middlesex, ss.

To   Timothy Jackson  of  Newton   in the county of Middlesex,    administrator of the Estate of Joshua Fuller Jr.   late of  Newton  in the said county of Middlesex, deceased,  Yeoman,  and to heirs at law, legatees and creditors of said deceased, and to all others concerned in said estate,                                                                      GREETING

WHEREAS the said  Timothy Jackson  has presented for allowance, to the Honorable James Prescott, Esquire, Judge of Probate of wills and for granting letters of administration in and for the said county of Middlesex the first account of his administration upon sais estate, and also an account of his claims against said estate as a creditor thereof. 

You are therefore hereby directed cited to appear, before the said Judge, at a Court of Probate, to be holden at Cambridge   in and for said county of Middlesex, on the last Tuesday of August next, to show cause, if any you have, either for or against same.

And you the above named  Timothy Jackson  accordingly are hereby ORDERED to serve this citation, by notifying all persons concerned in said estate and interested therein, by causing a true copy hereof to be inserted three weeks successively in the public newspaper call the New England Palladium  printed in Boston by  Young Minns,  the last publication to be at least  fourteen  days before the said last Tuesday of August; and to make due return hereof with your doings therein unto the said count.

Witness the said  James Prescott,  Esq. Judge as aforesaid, under his seal official, as Concord  this ninth day of June  in the year of our Lord one thousand eight hundred and six.

The forgoing claim of Timothy Jackson of the estate of Joshua Fuller Junior late of Newton in said County Husbandman deceased intestate being this day established on oath by said Ad[mintrato]r as a creditor of said intestate and the heirs at law and creditors and all others concerned in said estate having been first dully cited to appear at the said court by although namely called no person appeared to make any exception thereto and having carefully examined the same and make all needful enquiries relating thereto and fully understood the same, I do hereby approve and allow thereof and order that the same be added to the list of claims reported by the commissioners against said estate represented insolvent whereby the said administrator may be entitled to his dividend in proportion to the aforesaid claims as the law in such cases provided.   [signed]  James Prescott  J. Middlesex ss.   At a Court of Probate, holden at  Cambridge   in and for said county, the  twenty ninth    day of  August   A.D. 1806

HAVING examined and adjusted the foregoing   account   exhibited by  Timothy Jackson

the Adm[inistra]tor  above named, after citation and due notice to all persons interested in said estate and  no person appearing to make any objection thereto &c. and

the said  Adm[inistrat]or   having this day made oath, that said account is just and true, and having seen and fully understood the vouchers and evidence touching the same, and made all needful inquiries relative thereto, it appears to the Judge of said court, that the said account is just and reasonable, and ought to be allowed:

It is therefore decreed by the said Judge now here, that the same be, and it is hereby accordingly approved and allowed, and ordered to be recorded.

29 Aug 1806 – Final Distribution of Estate by Order of the Court

Commonwealth of Massachusetts

Middlesex ss:   To All People to whom these Presents shall come,  James Prescott  Esq, Judge of Probate, &c. in said County, sendeth      Greeting,

KNOW YE,   That it appears to me from the first Account of Timothy Jackson  Administrator of the Estate of Joshua Fuller junior, late of Newton in said County,  yeoman deceased, intestate, this Day alloed of Record in the Probate-Office, that a Balance rests in his Hands, amounting to  Three Hundred & sixty six Dollars & ninety eight cents. [$366.98]  

It also appears to me from the Report of the Commissioners by me appointed and sworn to receive and examine the Claims of the several Creditors to said Estate, which has been filed more than twenty Days in the Probate-Office, that the whole Claims liable to be liquidated amount to  Eight Hundred and eighty five Dollars & four cents        including a claim of Timothy Jackson the administrator as a creditor, which is admitted by the said Judge added to the report.

I do therefore order  said Administrator to pay to the following Persons the Sum of Money affixed to their respective Names, they being all Creditors in said Report, who have Claims subject to Liquidation; the Payments being in the proportion of  forty cents for every Dollar   of the respective Debts, which is all they can receive till further Discovery of said Deceased’s Estate. The sum of   Thirteen Dollars & 15 cents  is left in said Administrator’s Hands to pay the future Costs of Administration.
